Terms & Conditions (The Legal Stuff)

1. INTRODUCTION

BEFORE CREATING AN ACCOUNT TO CLAIM BOSS BENEFITS REWARDS, YOU MUST READ THE BELOW TERMS AND CONDITIONS AS THEY CONTAIN IMPORTANT INFORMATION ABOUT THE TERMS ON WHICH REWARDS CAN BE CLAIMED.

REDEMPTION INSTRUCTIONS ARE DEEMED TO FORM PART OF THE TERMS AND CONDITIONS AND BY PARTICIPATING, ALL CUSTOMERS WILL BE DEEMED TO HAVE ACCEPTED AND BE BOUND BY THE TERMS AND CONDITIONS. PLEASE RETAIN A COPY FOR YOUR INFORMATION.

Promoter: LC International Limited, a company registered in Gibraltar and having its registered office at Suite 6, Atlantic Suites, Europort Avenue, Gibraltar (trading as “Gala Bingo”).

Administrator: TLC UK Marketing Limited, a company registered in England with its registered office at 54 Baker Street, London, W1U7BU (“TLC”).

  1. The Boss Benefits rewards platform (the “Promotion”) is available to selected customers of Gala Bingo that meet the Qualification Criteria defined in clause 4 below.
  2. If invited to participate in the Promotion and upon successfully registering an account, Eligible Customers will be able to redeem certain rewards, offers and discounts (together the “Rewards”).
  3. The Promotion, its features, Rewards and any complaints related to it are all administrated and provided by TLC.
  4. The Promotion and Rewards are provided by TLC on behalf of Gala Bingo. Gala Bingo is not liable nor responsible for the administration of the Promotion or use of any Rewards.
  5. Access to and use of the Promotion and the redemption of any Rewards is subject to these terms and conditions. By registering an account to access the Promotion (a “Boss Benefits Account”), Eligible Customers agree to be bound by these terms and conditions. If an Eligible Customer does not agree with or accept any of these terms, they must not register for a Boss Benefits Account.
  6. The Gala Bingo general Terms and Conditions (found here) shall continue to apply to Eligible Customers in relation to their www.galabingo.com account (the “Gala Bingo Website”).

2. PROMOTIONAL PERIOD

This Promotion will be available to Eligible Customers from Monday 17 May 2021 00:00 (UK time) until Tuesday 17 November 2021 at 23:59 (UK time). The Promotion will extend after this period but the Qualification Criteria (defined below) and other significant terms may change.

3. WHO IS AN ELIGIBLE CUSTOMER?

  1. Access to this Promotion and the ability to register and maintain a Boss Benefits Account is only available to Gala Bingo customers who have completed any Qualification Criteria stipulated by Gala Bingo and have subsequently been invited by Gala Bingo to participate in this Promotion (an “Eligible Customer”).
  2. To access this Promotion, at all times an Eligible Customer shall need to:
    1. be over 18 years old;
    2. reside in and access their Gala Bingo Website account from the United Kingdom; and
    3. hold an active Gala Bingo Website account.

4. QUALIFICATION CRITERIA

To obtain, maintain or re-activate a Boss Benefits Account, an Eligible Customer will need to deposit and wager the relevant amount stated on the Gala Bingo Website within a consecutive 28-day period (the “Qualification Period”)

(together the “Qualification Period”).

5. OPENING AN ACCOUNT

  1. Upon meeting the Qualification Criteria for the first time, the following Monday an Eligible Customer will receive an introductory email from TLC directing them to www.bossbenefitscard.com to create a Boss Benefits Account (the “Introductory Email”).
  2. Eligible Customers will have 28-days from the date of the Introductory Email to register their Boss Benefits Account and redeem available Rewards within this Qualification Period. After this period registration will be withdrawn and an Eligible Customer will have to complete the Qualification Criteria in a future Qualification Period should they wish to gain access to the Promotion.
  3. The Introductory Email shall be sent to the email address registered against an Eligible Customer’s Gala Bingo Website account. Introductory emails and messages related to Qualification Criteria, account closure and/or re-activation shall be sent to an Eligible Customer’s Gala Bingo Website account and associated email address.
  4. Eligible Customers may only create one Boss Benefits Account for the Promotion.

6. MAINTAINING ACCESS TO THE PROMOTION

  1. To maintain access to their Boss Benefits Account, an Eligible Customer will need to complete the Qualification Criteria in every consecutive Qualification Period after the date of the Introductory Email.
  2. An Eligible Customer will be notified via email by TLC the following Monday upon completing the Qualification Criteria for a Qualification Period.
  3. An Eligible Customer can check on their progress in completing the Qualification Criteria by checking their Gala Bingo Website account transaction history.
  4. Unless otherwise determined by Gala Bingo, if an Eligible Customer fails to maintain the Qualification Criteria, that Eligible Customer’s Boss Benefits Account shall be deactivated at the end of the relevant Qualification Period.
  5. All Boss Benefits Accounts shall terminate twenty-eight (28) days after the end of the Promotion’s last Qualification Period.

7. RE-ACTIVATING AN ACCOUNT

  1. If an Eligible Customer’s Boss Benefits Account has been de-activated, they must complete the Qualification Criteria in a Qualification Period to regain access. If this is subsequently done, an Eligible Customer shall receive an email from TLC requiring them to click on a link, access a webpage and log-in to their existing Boss Benefits Account. An Eligible Customer will not need to re-register for another Boss Benefits Account.
  2. If an Eligible Customer’s Boss Benefits Account is re-activated, they will need to comply with the requirements outlined in clause 6 above in order to maintain access to the Promotion.

8. BOSS BENEFITS ACCOUNT CLOSURE

  1. Eligible Customers have the right to close their Boss Benefits Account at any time. Eligible Customers can do this by emailing their account closure request to [email protected].
  2. Once an account closure request is submitted, an Eligible Customer will have 28 days after the end of the relevant Qualification Period to access their Boss Benefits Account and redeem Rewards. After this period, an Eligible Customer will no longer be able to access the Promotion and/or redeem Rewards. Please note that if an Eligible Customer opts out of the Boss Benefits Card Promotion at any time, access to their Boss Benefits Account will be terminated and as such will no longer be entitled to access the Rewards.
  3. If an Eligible Customer’s Gala Bingo Website account is closed (for whatever reason), then their Boss Benefits Account will also be deactivated at the end of the relevant Qualification Period and they will no longer be able to access their Boss Benefits Account and/or redeem Rewards. If an Eligible Customer subsequently re-opens a Gala Bingo Website account and completes the Qualification Criteria, their Boss Benefits Account shall be re-activated in accordance with clause 7 above.
  4. An Eligible Customer shall have their Boss Benefits Account deactivated at the end of the Qualification Period if they: (i) “self-exclude”, “cool off” and/or “time-out” from gambling services with Gala Bingo (ii) close their Gala Bingo Account temporarily or permanently; (iii) have their Gala Bingo Website account restricted, suspended or closed (whether temporarily or permanently) by Gala Bingo; (iv) breached any of these terms and conditions (v) committed misconduct, being abusive and/or offensive to TLC; or if Gala Bingo has reasonable grounds in its sole discretion to request TLC to deactivate the relevant Boss Benefits.

9. BOSS BENEFITS ACCOUNT TERMS OF USE

  1. Each Eligible Customer is responsible for the proper use and security of their Boss Benefits Account.
  2. In the event of circumstances outside the reasonable control of TLC and Gala Bingo, or otherwise where fraud, abuse, and/or an error affects or could affect the proper operation of this Promotion or the redeeming of Rewards, and only where circumstances make this unavoidable, TLC and Gala Bingo reserve the right to cancel or amend the Promotion or these terms and conditions, at any stage, but will always endeavour to minimise the effect on Eligible Customers in order to avoid undue disappointment.
  3. TLC and Gala Bingo reserves the right to refuse to award a Reward or withdraw Reward entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions, the spirit of the promotion, any instructions forming part of this promotion’s redemption requirements or otherwise where a participant has gained unfair advantage in participating or redeemed using fraudulent means.

10. REDEEMING REWARDS

  1. In order to redeem Rewards, Eligible Customers must log into their Boss Benefits Account and select the desired Reward for redemption. Once redeemed, a confirmation email will be sent to the email address registered with that Eligible Customer’s Boss Benefits Account. Eligible Customers may also be required to provide additional information e.g. postal address or Date of Birth in order to claim a specific Reward.
  2. Eligible Customers may redeem as many different Rewards available to them as they want. Eligible Customers can only redeem those Rewards available when accessing their Boss Benefits Account. There may be restrictions in the number of times a Reward can be redeemed by Eligible Customers. Any limit on the number of times a Reward can be redeemed will be stipulated within that Reward’s specific terms.
  3. Approximately 100 Rewards will be available to be redeemed at any one time. However the exact amount of Rewards will vary throughout the Promotion. Examples of Rewards that may be available are 8.5% off Costa Coffee and/or Rewards with various restaurants.
  4. Rewards are subject to availability, substitution, change without notice and may be altered or withdrawn by TLC at any time.
  5. TLC facilitates the provision of Rewards for the Promotion. Rewards are provided to TLC by third party suppliers. Gala Bingo takes no responsibility for the supply, quality, description, functionality and/or use of Rewards that are redeemed by Eligible Customers.
  6. Rewards can be used for personal use only and are not to be used by Eligible Customers in any commercial capacity. TLC has the right to withdraw any Reward and/or invalidate its redemption if TLC reasonably identifies a breach of this clause.
  7. g) Any Reward may be subject to additional terms and conditions and policies of a third party that the Reward is to be redeemed with (“Additional Terms”). Additional Terms may change from time to time without notice and Eligible Customers are responsible for checking Additional Terms before redeeming any Reward and complying with any Additional Terms thereafter.

11. AD-HOC REWARDS

Certain Eligible Customers may be offered additional Rewards from time to time, via email from TLC. These additional rewards will not be subject to any wagering requirements. Any additional rewards will need to be redeemed by an Eligible Customer by accessing their Boss Benefits Account and may be subject to Additional Terms.

12. ADDITIONAL TERMS

  1. TLC and Gala Bingo are not responsible for and assume no liability for any Reward provider’s Additional terms, privacy policies, usage policies, products or services (or any change to these from time to time).
  2. TLC and Gala Bingo have no responsibility or liability of any kind in respect of Rewards provided by a Rewards provider.
  3. Rewards are non-transferable and cannot be exchanged for cash. No alternative Reward will be provided in whole or in part, except that in the event of circumstances outside of its control the TLC and Gala Bingo reserves the right to substitute a similar Reward of equal or greater value.
  4. If fulfilment or any element of this Promotion is delayed or affected due to the continuing Covid-19 pandemic and resulting Government restrictions, all entrants affected will be contacted by TLC and kept updated of any unavoidable changes to the Promotion dates or Rewards.
  5. TLC, Gala Bingo and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using their Reward, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  6. TLC and Gala Bingo has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. TLC and Gala Bingo will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

13. ACCOUNT SECURITY

  1. Eligible Customers are responsible for the security details relating to their Boss Benefits Account (including any passwords or log-in details).
  2. TLC will not be responsible for any loss arising from an Eligible Customer failing to keep their Boss Benefits Account details safe.
  3. Rewards are non-transferable and cannot be exchanged for cash. No alternative Reward will be provided in whole or in part, except that in the event of circumstances outside of its control the TLC and Gala Bingo reserves the right to substitute a similar Reward of equal or greater value.

14. DATA PROTECTION

  1. By participating in the Promotion, Eligible Customers acknowledge and accept the use of personal data by TLC according to these terms and conditions and Gala Bingo’s Privacy Notice. Your personal details will at all times be kept confidential and in accordance with current Data Protection legislation.
  2. Any personal data (e.g. full name and email address) relating to Eligible Customers will be used solely for the purpose of operating the Promotion, responding to customer queries and/or requests and to provide technical or functional support. Eligible Customers will automatically be enrolled into the functional email communications for the management of the Promotion. This communication will be sent to the email address registered against an Eligible Customer’s Gala Bingo Website account. Eligible Customers will not be contacted for marketing purposes by TLC or Gala Bingo unless they have explicitly opted in to receive such marketing communications.
  3. TLC may offer links to other websites, including those of our Reward providers. If an Eligible Customer visits one of these linked websites, they are then subject to the privacy notices and other policies of such websites. TLC are not responsible for, or able to monitor or control, the policies and practices of other companies, including with respect to their collection, use or disclosure of an Eligible Customer’s personal information.
  4. Eligible Customers can exercise their data privacy rights or withdraw from the Promotion at any time by contacting [email protected]. By participating in the Promotion, you agree to the use of your personal data as described here.

15. GOVERNING LAW AND JURISDICTION

  1. These terms and conditions and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
  2. TLC and you agree that, English courts shall have exclusive jurisdiction over any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims) unless you live in another part of the UK, in which case your local courts will have jurisdiction.

16. INAPPLICABLE TERMS

If any of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the remaining terms and conditions.
